Terms and Conditions B2C

Please read our terms and conditions carefully before registering and making a purchase. By making a purchase, you accept and agree to the applicable terms and conditions.

1. General

By placing an order, you are also deemed to confirm that you are 18 years old and not under guardianship. By placing an order on dariuscosmetics.se, you accept the terms and conditions published at the time, as stated below, and certify that the information you provide about yourself is correct. The terms we, our, ours, us, and DC below refer to Darius Cosmetics AB (hereinafter "DC").

DC reserves the right, from time to time, to change these General Terms and Conditions without prior notice to you as a Customer regarding the changes in question. However, the General Terms and Conditions published on dariuscosmetics.se at the time you place your order will apply to your product order. If the General Terms and Conditions change after you have placed your order, the General Terms and Conditions that were published at the time of your order will apply to all matters concerning your order, i.e., both for the purchase and any return process.

2. Prices

The prices displayed at the time of your order apply to your purchase. Prices are stated in Swedish kronor (SEK) and include value-added tax (VAT). DC retains ownership of the products until full payment has been received.

For orders under SEK 1000 (including VAT), a delivery cost of SEK 99 will be charged. If the order value exceeds SEK 1000 (including VAT), the goods will be shipped free of charge. The delivery cost will be presented in the order process, where you will receive information about the total amount you will pay for your order (including any delivery costs) under "total sum" before your order becomes binding for the products you have placed in the shopping cart.

If DC incurs additional costs due to abnormal handling by you as a consumer regarding shipping or providing incorrect personal data, DC reserves the right to subsequently invoice for the incurred costs.

3. Choosing the right product

If you are unsure about your skin type or which product suits you, you are welcome to contact our certified skin therapists free of charge at info@dariuscosmetics.se before you complete an order.  

The advice we provide is general and based solely on the information you provide digitally. DC therefore cannot guarantee that the product is always fully suitable for your individual skin. We recommend that you always perform a patch test on a small skin area for at least 24 hours before full use.

DC is not responsible for reactions or discomfort that could reasonably have been avoided by following the advice we provide/have provided or if the product is used with other facial products from brands other than those supplied by DC.

4. Payment

We currently offer the following payment options in collaboration with Shopify Payments and Klarna Bank AB (publ):

Together with Shopify Payments

  • Credit or debit card (Visa, Mastercard).
  • Apple Pay and Google Pay (for compatible devices).

Payment is handled by Shopify Payments according to their terms of use. No card information is stored by DC.

Together with Klarna Bank AB (publ), Sveavägen 46, 111 34 Stockholm, Sweden, we offer the following payment options where payment is made directly to Klarna.

  • Card payment (VISA, Mastercard and American Express)
  • Pay within 14 days: The payment period is 14 days from the dispatch of the goods.
    The terms for paying within 14 days can be found here.
  • Account: Klarna Account is a credit account provided by Klarna that gives the borrower the opportunity to pay for their purchases monthly with at least 1/24 (minimum SEK 50) of the total utilized credit amount or in accordance with the terms approved at checkout. For more information about Klarna Account, including general terms and conditions and standardized European consumer credit information, please find it here.
  • Pay Directly: Automatic debit from your bank account: based on direct debit, and your account will be debited approximately two banking days after the purchase is completed or the item is shipped. The terms for using direct debit can be found here.
  • Bank transfer: Your account will be debited immediately after the order has been placed.

To offer a range of different payment options, we need to share your personal, contact, and order details with the provider of the respective payment service. We recommend that you read our GDPR/Privacy Policy.

The use of this information is regulated in accordance with applicable data protection law and Klarna's privacy policy.

5. Out of stock items

If any item you ordered is out of stock when your order is being packed, only the items you ordered and that are in stock will be delivered to you. If you were not charged for shipping when the order was placed, you will not be charged for shipping once the order has been updated.

6. Notification

After placing an order and making a purchase, you will receive an email with information about your completed purchase. When the order is shipped from our warehouse, you will receive an email notification with a tracking link. You will then receive an SMS notification.

7. Deliveries

Normally, the delivery time is 1-5 working days depending on the address. Some deviations may occur. We deliver goods with DHL to the nearest service point. We do everything we can to deliver your goods as quickly and safely as possible.

DC is not responsible for delays or damages caused by government action, war-like events, labor disputes, lack of transport, fire, seizure, shortage of goods, or other circumstances beyond DC's control, which either hinder or complicate DC's fulfillment to such an extent that it cannot be done other than at abnormally high cost. The same applies to delays in deliveries from supplier to DC in accordance with similar circumstances.

8. Damage to packages and unclaimed packages

If you discover damage to the package, you must immediately report this to the shipping agent. Do not accept a damaged package.

If it cannot be resolved with the agent and a dispute arises, please contact us.

For deliveries returned to DC because the recipient refused to accept the goods or provided incorrect information, DC reserves the right to charge you a fee of up to SEK 450 to cover fees, damaged goods, and administrative costs.

9. Complaints and returns

If you have received a damaged product or a product is missing from your order, you should file a complaint. Complaints about faulty products should be made as soon as a defect in the product is discovered and it can be considered faulty or unfit for its intended purpose. Any defect in a product must be reported to DC's customer service as soon as possible or as soon as the defect should have been discovered, within a reasonable time.

Returns can only be made if DC has delivered the wrong product/products or by decision from DC regarding the return of product/products. DC covers complaint costs if the damage is considered a manufacturing defect. DC is not responsible for defects that have arisen due to damage, wear and tear, or neglect. In the event of an approved complaint, we cover any costs, such as shipping fees and refunds using the same payment method used for the purchase.

A return slip will be sent to you as a consumer from DC's customer service. When returning product/products, you must also provide information about the defect in accordance with what has been agreed with customer service. We do not accept packages sent to us in any other way than with our return slip and instructions. Always remember to return the products in their original packaging.

Note that hypersensitivity to ingredients in a product or sample is not considered a defect. If you are unsure what the product or sample contains, contact us at info@dariuscosmetics.se for a consultation with one of our skin therapists before use/ordering.

As a customer, you are responsible for the product until it has been received by our returns department, which includes the risk of the product being damaged or lost during shipping back to us. Package well.

We at DC comply with Swedish law and ARN's (National Board for Consumer Disputes) recommendations.

10. Refunds

Refunds are automatically made using the same payment method you used to pay for your products. If the payment was made by invoice or by prepayment, the refund will be made to the account from which the payment was made. If necessary, we may therefore need to ask you for your account details.

11. Intellectual Property Rights

All intellectual property rights belonging to DC, its group companies and/or licensors, including but not limited to trademarks and works protected by copyright reproduced on dariuscosmetics.se, belong to DC, its group companies and/or its licensors. This means that any use of dariuscosmetics.se or its content that constitutes use other than that which falls within a customer's actions regarding orders, administration, and use of services related to the Customer's purchase of DC's products requires prior written permission from DC. To avoid ambiguity, this means that all copying or storage of content from dariuscosmetics.se, in whole or in part, for purposes other than a customer's private, non-commercial use, requires prior written permission from DC. This restriction includes, but is not limited to, trademarks, company names, product names, images, photos, graphic design elements, and information about DC's products.

12. Force Majeure

DC is not obliged to fulfill the purchase if there is an impediment that DC cannot overcome or if fulfillment would require sacrifices that are not reasonable taking into account the customer's interest in DC fulfilling the purchase. The customer is also not entitled to compensation for the damage that the customer suffers due to DC's delay or fault if the delay or fault is due to an impediment beyond DC's control that DC could not reasonably have been expected to take into account at the time of purchase and whose consequences DC could not reasonably have avoided or overcome.

13. Right of Withdrawal

If you wish to cancel your purchase or any product from your order, you must inform us within 14 days of receiving the package, in accordance with the Distance Contracts Act. For your return to be approved, the product must be unopened, unused, and in its undamaged original packaging with associated packaging and seal. We do not accept returns/complaints for products you have used but that do not meet your expectations. In the event of known allergies or hypersensitivity, we always recommend that you test a new product on a small area of skin and wait 24 hours to see if there is any reaction.

Always contact customer service before returning goods. When exercising the right of withdrawal, the customer is responsible for the return shipping at a cost of SEK 99 plus any payment fees. If customer service is not contacted beforehand, the return will be handled as a refusal to accept the goods or incorrect address provided, and DC reserves the right to charge you a fee of up to SEK 450 to cover fees, damaged goods, and administrative costs.

DC is not responsible for shipments not sent with a return slip from our customer service. We do not collect packages, letters, or packages at the specified company address. We collaborate with a 3PL warehouse solution.

The costs will be automatically deducted from the value of the goods we refund upon approved return and will be repaid within 30 days. If the return is not approved, all costs will be invoiced.

14. Processing of personal data

By making a purchase, you simultaneously approve our GDPR/Privacy Policy.

15. Applicable law and dispute

In the event of a dispute between DC and the customer, the customer has the option to turn to the National Board for Consumer Disputes for dispute resolution. DC undertakes to comply with decisions from the National Board for Consumer Disputes. The National Board for Consumer Disputes can be reached either via the website www.arn.se or by addressing Box 174, 101 23 Stockholm. You can also complain via the EU's online platform for dispute resolution, which you can access via http://ec.europa.eu/consumers/odr.

These terms shall be interpreted in accordance with Swedish law and, without prejudice to what is stated in the paragraph above, decided by a general court.
